2836014 ONTARIOINC., operating as goHeather or Heather, is not a law firm or a lawyer; it is software that provides information as a service on website and applications. You do not have solicitor-client privilege with goHeather.

goHeather is an application that creates and analyzes documents like an employment contract.

This Privacy Policy outlines how we handle your personal information to protect your privacy.

For All Users: We collect what you provide us. For example, if you upload a document on our application, we collect the information contained in that document. Some of this information may be private and confidential to you. If you do not want goHeather to collect certain information that is private and confidential to you, do not upload documents that contain such private and confidential information and do not input any of this kind of data on our forms.

For AI Contract Analysis: We pass the entire text of the document you upload to our website or application to OpenAI, which is a third-party AI API that we use to complete our AI contract analysis service. View OpenAI’s privacy policy policies here.

For Employers Using Our Contract Builder: We generally collect your email addresses, phone numbers, locations, industry type, and a list of your employees. Your payment information like credit card numbers are stored by our service provider, Stripe, not us.

For Candidates of Employers Our Contract Builder: We collect your name, email address, phone number, location, birthday and emergency contact.

Communication Information: If you communicate with us, we collect your name, contact information, and the contents of any messages you send using various third-party services like email, cloud and CMS systems (Gmail, AWS, TypeForm, Intercom, Auth0, OpenAI) in which case such information may be passed to the systems as well.

We collect content and such personal information as described above to build and analyze contracts electronically and we store such information on a dashboard on our application for you to view and for no other purpose.

We also collect log data, analytics and user information to review and analyze your use of our services to help us improve our services.

We do not sell your content or personal information except if we are involved in the sale of our own business, reorganization, bankruptcy, receivership, or transition of service to another service provider.

Please do not send us or input on any form on goHeather sensitive information like social security information or direct deposit information. If you need to store that information, please use another method outside of goHeather. goHeather does not ask for or store sensitive information like social security information or direct deposit information. For example, if you wish to upload a contract on our website or application that contains your social security number, please remove your social security number before doing so.

We also collect cookies to track and follow visitors to our website and our application to view usage analytics and to serve and buy ads.

Privacy Legislation

Since January 1, 2004, all Canadian organizations engaged in commercial activities have been required to comply with the Personal Information Protection and Electronic Documents Act (“PIPEDA”) and the Canadian Standards Association Model Code for the Protection of Personal Information incorporated by reference to PIPEDA.  

Personal Information

Personal information is defined in PIPEDA as information about an identifiable individual but does not include the name, title or business address or telephone number of an employee of an organization. In other words, it does not include the information that one expects to find on a business card.

Consent to Our Collection of Personal Information

By using goHeather, we obtain your consent to collect, use and disclose your personal information.

Generally, we collect your private information from a form submission on this website or when you use our application.

Use of Personal Information at goHeather

We use your personal information to provide contract building services, to issue invoices and to maintain our database dashboard system.

In addition, if someone applies for a position with goHeather, we will use their personal information to assess their candidacy.

Withdrawal of Consent

You may withdraw your consent to our collection, use and disclosure of your personal information at any time, subject to legal and/or contractual restrictions and upon reasonable notice. Your withdrawal of consent to our collection, use and disclosure of your personal information may impact our ability to provide services to you.

Disclosure of Personal Information

Generally, we do not disclose your personal information to third parties without your consent unless permitted or required by applicable laws or court orders.

goHeather creates contracts for employers. When a goHeather customer employer hires an employee using goHeather, goHeather asks for the personal information of the employee like name, address, birthday and email address. When we receive this information from a goHeather customer's employee, we disclose such personal information to our customer's employer.

Storage of Your Information

We retain personal information in an online database to provide services to our customers.

Safeguards

goHeather uses various safeguards to ensure that personal information is protected against loss, theft, misuse, unauthorized access, disclosure to third parties, copying or alteration. These include industry-standard cloud security measures native to our cloud and API partners, and other protections like internal 2FA to prevent unauthorized access or “hacking” and customer passwords that restrict access to our systems.

Access to your Personal Information

You have a right to challenge the accuracy and completeness of your personal information on goHeather and to have it amended, as appropriate. You also have a right to request access to your personal information and receive an accounting of how that information has been used and disclosed, subject to certain exceptions prescribed by law or if it has been deleted. For example, if the requested information would reveal personal information about another individual, your request for access may be limited or denied.

Challenging Compliance

goHeather will respond to inquiries about its policies and practices relating to its handling of your personal information. If the complaint is found to be justified, goHeather will take appropriate measures to resolve it, including, if necessary, amending this Policy and its procedures.

Website Privacy

Like most other commercial websites, we may monitor traffic patterns, site usage and related site information to optimize your visit to our website. We do not use electronic means to collect personal information from you or your computer except from our form submissions and your and your employee's use of our contract builder application; however, like most websites, our website server will automatically collect IP addresses and cookies. We may view the IP log from time to time and also view traffic information from cookies, for example, to maintain and grow the use of our website. We may also view your IP to determine what jurisdiction you are in so we can serve you the appropriate features of our application.
